Who Will Really Be Doing the Work On Your Case?

When you see a personal injury law commercial, and you see the attorney on the commercial, do you think that attorney is the attorney that is going to be working on your case on a day to day basis? It could be, but probably not. What that means is that, prior to going into that firm, you might not know who is going to be working on your case..

“Will it be you (the partner in the firm) doing the work or will it be a junior associate?”

If you do choose to go in and meet with a partner in a law firm, make sure that during the meeting, you ask the partner if the work will performed by that partner, or if the work be assigned to a junior associate who will actually be doing the bulk of the work and negotiating with the insurance adjusters. If it is a junior associate doing the work, ask what kind of experience they have. Here are some questions to ask:

  • Are they fresh out of law school? Is this their first job?
  • Are a seasoned professional with trial experience?
  • Do they have prior personal injury law experience?
  • Do they have settlements and awards that they can share with you?
  • Will they be handling your case, or are they going to have a case manager pushing the case forward?

These are all really important questions to ask during that first interview with a law firm.

Three Qualities To Look For When Hiring a Personal Injury Attorney

What qualities do we need to look for when hiring a personal injury attorney?

Is it just the experience that is the most important? Or maybe there’s even more to it.

These are in no particular order and are simply suggestions.  These qualities are what we would look for if we were hiring a personal injury attorney.

1. Communication

Communication is key in a personal injury case on both ends. You want a lawyer who is communicating with you and you want to be communicating with your lawyer. But how do you know if you and an attorney will have good communication? You can start with the initial call.

On that initial call, are you speaking with a secretary who’s just trying to sign you up to get you into an appointment? Or, are you getting your questions answered by an attorney on the phone? If it were us, we would want to call a law firm and talk to the attorney on the phone first to find out if we even have a case.  It is also important to get a feel for the attorney to see if they are the right fit, before taking time to travel to their office and sit down with them in person.

Speaking with an attorney on the front end, and figuring out if they’re communicative will save you some trouble on the back end when you realize that your lawyer is not calling you back.

2. Enthusiasm

Is your lawyer enthusiastic? Do they have a good personality? Or are they dry, boring, and stuffy?

Make sure they have some enthusiasm. Make sure they’re happy and that they are doing what they like to do. The way they interact with you is likely the way they’re going to interact with an adjuster on the phone. Trust us, you get way further with an adjuster if you’re enthusiastic about your client, your client’s case, and what you do!

Liking what you do is important. It will show in your meeting with the attorney, and in that attorney’s communications with the adjusters or defense counsel.  So, make sure you’re hiring an attorney who seems happy and is enthusiastic about what they’re doing.

3. Experience

This is an obvious factor. What experience does this attorney have? How long have they been out of law school? Do they have insurance defense experience?

So, find out what kind of experience the attorney has, such as their level of trial experience, how long they’ve been an attorney, and what type of practice they have worked at in the past.

Those are just three things that we would look for if we were hiring an attorney.

You might look for something different as there might be something more important to you. But remember that communication, enthusiasm, and experience go a long way in handling your injury claim.
